State Law Updates
 |
The medical spa arena continues to be a site of great debate, with each state arguing the fine points of who should have the authority to treat and supervise.
• In Florida, Gov. Jeb Bush has signed into law a state bill that restricts the number of satellite offices for primary physicians to four. Dermatologists will be restricted to two satellite offices for now, and to only one by July 1, 2011. The law also states that only dermatologists and plastic surgeons will be permitted to perform Botox injections, medical microdermabrasion, chemical peels and laser rejuvenation treatments in a satellite office, with primary care physicians and other doctors being permitted to perform these services in their primary offices only. For more information visit www.flsenate.gov.
• In California, proposed State Bill 1423, initially designed to increase a medical spa’s supervising physician’s presence on the spa premises during procedures, has been temporarily held back in light of vehement protests from the medical community. The bill is currently being re-evaluated by the Medical Board of California and the Board of Registered Nursing, and a report will be submitted to the State Legislature by January 1, 2008.
